These Terms of Use ("Terms") govern your access to and use of oneday.dating and related website-based waitlist and communications services (collectively, the "Site").
The Site is operated by One Day Dating Inc. ("One Day," "one/day," "we," "us," or "our").
By accessing the Site or joining the one/day waitlist or communications list, you agree to these Terms.
These Terms do not govern use of the one/day dating application or dating service. If and when the one/day application becomes available, its use will be governed by separate terms.
You must be at least 18 years old to join the one/day waitlist or communications list or otherwise submit personal information through the Site.
By joining, you represent that you are at least 18 years old and legally capable of agreeing to these Terms.

The Site may allow you to join a waitlist or receive information regarding one/day.
Joining the waitlist or communications list does not guarantee:
We may determine the timing, availability, eligibility criteria, geographic rollout, and manner in which access to one/day is offered.
We may modify, suspend, or discontinue all or part of the Site or waitlist at any time.
You agree that information you provide through the Site will be accurate and that you are authorized to provide it.
You may not submit another person's email address or telephone number without authorization.
You are responsible for notifying us or updating your communication preferences if information you supplied changes.
By providing your email address and joining the one/day list, you agree that One Day may send you emails relating to one/day.

You may unsubscribe from marketing emails at any time using the unsubscribe method provided in our emails.
Participation in One Day's text-message program is optional and requires a separate affirmative opt-in.
If you separately consent to receive text messages, you may receive recurring informational and marketing text messages from One Day Dating Inc. concerning one/day, including messages regarding waitlist information, launches, new locations, product updates, features, news, events, surveys, offers, and promotions.
Messages may be sent using automated systems or technologies that select and dial telephone numbers.
Consent to receive marketing text messages is not a condition of purchasing or using any One Day product or service.

We will honor other reasonable communications clearly requesting that we stop sending text messages when required by applicable law.
After an opt-out request, we may send a one-time message confirming that your request has been processed.
Wireless carriers are not responsible for delayed or undelivered messages.

The Site and its contents, including the one/day name and branding, logos, designs, text, graphics, software, layouts, and other materials, are owned by or licensed to One Day Dating Inc. and are protected by applicable intellectual-property laws.
Except as expressly permitted by us, you may not copy, reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from Site materials.
Nothing in these Terms grants you ownership of any One Day intellectual property.
If you voluntarily provide suggestions, ideas, or feedback concerning the Site or one/day, you permit us to use that feedback without restriction or compensation to you.
This section does not transfer ownership of personal information submitted through the Site; personal information remains subject to our Privacy Policy.
The Site may rely on or link to third-party services.
We do not control and are not responsible for third-party websites, services, availability, content, or practices.
Your use of a third-party service may be governed by that third party's own terms and policies.
We may modify, update, suspend, or discontinue any part of the Site at any time.
We do not guarantee that the Site will always be available, uninterrupted, error-free, or free from harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL INFORMATION AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE."
ONE DAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONE DAY DATING INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED $100.
These limitations do not apply where prohibited by applicable law.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, except to the extent applicable law requires otherwise.
Nothing in these Terms deprives you of protections that cannot legally be waived under applicable law.
We may update these Terms from time to time.
The current version will be posted on the Site with its effective date.
If required by applicable law, we will provide additional notice of material changes.
Your continued use of the Site after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
These Terms and any additional terms expressly incorporated into these Terms constitute the agreement between you and One Day concerning the Site.
Our Privacy Policy describes how we collect, use, and disclose personal information, and any separate communication consent you provide governs communications within the scope of that consent.
These Terms do not constitute the terms governing use of the future one/day dating application.
